Abstract
The aim of the present contribution is to analyze the scope of the Panel’s review in the appeal proceedings before the Court of Arbitration for Sports in case of disciplinary decisions issued by the disciplinary bodies of FIFA and UEFA. The paper reviews three major cases: the ‘Barcelona case’, the ‘Suárez case’ and the ‘Serbia v. Albania case’ in order to examine the relevant legal framework and the significant issues arising in these proceedings.
In particular, this paper addresses the issue of the balance between the full power of review conferred upon the Court of Arbitration for Sports in its capacity as an appeals arbitration body, and the scope of the discretionary powers of FIFA and UEFA in disciplinary matters.
